Sailing Rental Agreement for Competition - Members' Obligation and Waiver

In signing this booking agreement I agree that I have thoroughly read and understand the Terms and Conditions below and have paid all Fees, including Damage Deposit if requested. In the event of damage or loss I will immediately repair or replace equipment to Club standards at the Club’s discretion. Furthermore, I understand that my removal/rental of equipment from Club Locarno is entirely voluntary and at my own risk, and is an ACTIVITY entirely covered under the WAIVER AND CLAIMS, RELEASE FROM LIABILITY AND ASSUMPTION OF RISKS document that I signed on becoming a member of the Club. In particular, I waive any and all claims I may now and in the future have against, and release and forever discharge from liability, and agree not to sue the CLUB (as defined in the aforementioned document) for any personal injury, death, property damage or loss sustained by me as a result of my removing/renting Club  equipment from the JSCA facility due to any cause whatsoever , including without limitation, active or passive negligence, imprudence, lack of skill, error of judgment, breach of contract, or breach of statutory duty of care on the part of the CLUB.

Terms and Conditions

  • Removal of equipment without a completed rental form, pre-paid fees and Club approval is strictly forbidden. Members will be held liable for all rental charges and will face suspension of club privileges, which may lead to expulsion.
  • Rentals are for members only. You may not allow a guest to use the boat. 
  • You must be wearing a PFD when using the craft. 
  • Maximum booking is for 10 days including the days of departure and return.
  • Equipment may be picked up after sunset the day prior to the rental period.
  • The renting member must own or have access to proper transportation hardware, such as roofrack and strapping, and must know how to safely transport equipment.
  • Determination of damage or loss and who will be responsible for related costs is at the Club’s discretion.
  • The member should be prepared to take whole responsibility for all damage to Club equipment on a rental, regardless of circumstance, including theft. This said, the following are guidelines can be used to assist with determining responsibility:
    • You will be responsible for costs and repairing any damage that occurs due to negligence or a site specific incident (i.e. breaking a foil due to hitting a sandbar) and/or damage during transportation.
    • If damage occurs due to regular wear and tear on the boat, the club will cover the repair costs just as we would when sailing at Jericho.
    • The craft is covered by our hull insurance, so if theft or catastrophic damage occurs where we would make a claim on the insurance, Club Locarno will make that claim, you will not have to.
    • Note 1: the club's asset insurance covers use within (1) inland B.C. lakes and (2) the Coastal Waters of mainland B.C., the North and West Coast of Vancouver Island, the Puget Sound and adjacent waters, the Juan de Fuca Strait, and the Portland Canal, but at no time to proceed more than 20 nautical miles offshore or on the Fraser River east of the mouth of the Sumas River.
    • Note 2: Our asset insurance will not cover theft of the items while on trailers and detached from the towing vehicle unless the following precautions are taken: (1) Trailer is equipped with tongue ball lock and/or (2) Stored in a locked compound and/or (3) Chained to an immovable object. 

    • If you feel that you can't meet the requirements in Notes 1 and 2, it is recommended that the renting member possess household insurance that covers claims for loss of Club equipment to the minimum amount of $20,000.

  • Our member liability insurance covers you as a participant in racing events, as long as it is a club sanctioned event within the lower mainland. Your participation is club sanctioned. Our plan provides $2million liability with a $2,500 deductible.

  • Discuss with the appropriate captain or sailing director about which tools and spares you can take with you for the event. 
  • The director from whom you got permission to take the boat must be notified if you are delayed for whatever reason in returning equipment.
  • Before departure, you must take pictures of any damage you see on the craft before you load it for transport. 
  • Upon return, you must complete an inspection, comparing any damage to your before pictures. If new damage is found, you must report it on Locarno's craft sign-out system, AND discuss it via email or other communication means with the appropriate captain. 
  • Upon return, ensure all equipment is clean and put away in the proper locations (i.e. ropes and neatly coiled tie straps live in the kayak shed). Sign the craft back in.
